These Terms of Service govern the relationship between Ardent Wireless LLC (dba Ardent Network, dba Ardent Fiber) and you, the customer, regarding the provision and use of our internet access services (“Services”).
By subscribing to or using our Services, you agree to comply with these Terms and any related policies referenced herein. Please read them carefully, as they outline your rights, responsibilities, and limitations in using the Services.

1. Services Provided
1.1. Ardent Wireless LLC agrees to provide internet access services as selected by the customer on the install sheet (hereinafter referred to as “Services”).
1.2. The Services are intended for use by the customer only and are subject to the usage limitations specified by the selected plan.

2. Installation and Equipment
2.1. Installation fees, as agreed in the install sheet, are non-refundable once the installation is completed.
2.2. Any equipment provided by Ardent Wireless LLC, such as modems or routers, remains the property of Ardent Wireless LLC, unless purchased by the customer. The customer agrees to return the equipment upon cancellation of Services. Failure to return equipment will result in replacement fees.
2.3. The customer is responsible for maintaining any customer-owned equipment and ensuring compatibility with Ardent Wireless LLC’s network.

3. Service Fees and Payment
3.1. The customer agrees to pay the fees for the selected internet service plan and any additional services as listed on the install sheet.
3.2. Payments are due on the first day of each month. Late payments may result in service suspension, and late fees may apply.
3.3. The customer agrees to pay any applicable taxes, regulatory fees, or surcharges that may be imposed by federal, state, or local authorities.

4. Service Availability
4.1. Ardent Wireless LLC does not guarantee uninterrupted or error-free service. Service interruptions may occur due to factors beyond our control, including maintenance, outages, or network issues.
4.2. Bandwidth Guarantee
Ardent Wireless LLC guarantees bandwidth speeds as specified in the customer’s service plan, provided the connection is tested using a direct wired connection to Ardent Wireless LLC’s network, bypassing any customer-owned equipment. Speeds may vary when customer equipment, such as routers/firewalls or wireless devices, is in use.
4.3. For Dedicated Internet Access (DIA) agreements, guaranteed bandwidth speeds will be provided as specified in the service contract.
4.4. In the event of a prolonged outage, Ardent Wireless LLC will make reasonable efforts to restore service as soon as possible but will not be liable for any damages caused by the loss of service.

5. Acceptable Use
5.1. The customer agrees to use the Services in compliance with all applicable laws and regulations.
5.2. Prohibited activities include, but are not limited to:
• Engaging in illegal activities
• Spamming or sending unsolicited emails
• Attempting to disrupt the network or degrade service for other users
• Reselling, sharing, or otherwise distributing the Services to any third party, including but not limited to providing internet access to others through wireless or wired networks, without prior written consent from Ardent Wireless LLC.
• Using the Services to download, upload, or share copyrighted material without authorization.
5.3. Ardent Wireless LLC complies with the Digital Millennium Copyright Act (DMCA). Customers are responsible for responding to any DMCA notices received. Repeat violations may result in service suspension or termination.
5.3. Any violation of this clause may result in immediate suspension or termination of Services, as well as potential legal action.

6. Termination and Cancellation
6.1. Either party may terminate this agreement, and their Service, by providing a 30-day written (or emailed) notice.
6.2. Ardent Wireless LLC reserves the right to terminate services immediately for failure to comply with these Terms and Conditions, or if payment is overdue for more than 30 days.

7. Privacy and Security
7.1. Ardent Wireless LLC respects the privacy of its customers and will not share personal information with third parties, except as required by law or for necessary service provisioning.
7.2. The customer acknowledges that the ‘internet’ is not inherently secure and agrees to use appropriate measures to protect personal data and secure their devices.

8. Limitation of Liability
8.1. Ardent Wireless LLC is not responsible for any direct, indirect, incidental, or consequential damage that may arise from the use or inability to use the Services, including but not limited to loss of data or business interruptions.
8.2. Ardent Wireless LLC’s total liability to the customer for any claims arising under this agreement shall not exceed the total amount paid by the customer in the preceding three months.

9. Amendments
9.1. Ardent Wireless LLC reserves the right to amend these Terms and Conditions at any time. Customers will be notified of any significant changes. Continued use of the Services after notification constitutes acceptance of the revised terms.

10. Governing Law
10.1. This agreement shall be governed by and construed in accordance with the laws of Washington State.
